Information on the right of withdrawal from the contract
1. Right of withdrawal
The Consumer and the Entrepreneur with consumer rights have the right to withdraw from a distance contract without giving any reason within 14 days.
The withdrawal period expires after 14 days from the day:
a) on which the Consumer acquires possession of the Goods, or
b) on which a third party other than the carrier and indicated by the Consumer acquires possession of the Goods,
and in the case of a contract covering multiple Goods delivered separately, in batches or in parts – from the day of taking possession of the last Goods, batch or part.
2. Exercising the right of withdrawal
To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw from the contract by an unequivocal statement sent to:
Kubek Urody Dominik Hoffmann
ul. Obornicka 8A
62-002 Jelonek
Poland
e-mail: admin@kubekurody.pl
tel.: +48 732 448 881
To meet the withdrawal deadline, it is sufficient for the statement to be sent before the expiry of the withdrawal period.
The Consumer may use the model withdrawal form provided by the Seller, but this is not mandatory.
3. Return of Goods
The Goods should be returned to the following address:
Kubek Urody Dominik Hoffmann
ul. Obornicka 8A
62-002 Jelonek
Poland
without undue delay and no later than 14 days from the day of withdrawal from the contract.
The Consumer bears the direct costs of returning the Goods, unless the Seller has agreed to bear those costs or failed to inform about the necessity to bear them.
The Consumer may also use the InPost “Szybkie Zwroty” (Quick Returns) service by selecting the store “Kubek Urody” in the application or on the operator’s website. The use of this return method is voluntary and does not exclude other return methods. The cost of return via InPost Quick Returns is borne by the Consumer.
The Seller may withhold reimbursement until receiving the Goods back or receiving proof that the Goods have been sent back, whichever occurs first.
The Seller shall reimburse all payments received from the Consumer, including the costs of delivery of the Goods (except for additional costs resulting from the Consumer’s choice of a delivery method other than the least expensive standard delivery), without undue delay and no later than 14 days from the day on which the Seller is informed about the withdrawal from the contract.
Reimbursement will be made using the same means of payment as used by the Consumer, unless the Consumer has expressly agreed otherwise.
4. Liability for diminished value of the Goods
The Consumer is liable for any diminished value of the Goods resulting from the use of the Goods beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
In particular, this applies where:
a) the product has been opened,
b) seals, protective foil or other security features have been broken,
c) the product shows signs of use,
d) the packaging has been damaged,
e) the product is no longer suitable for resale as a full-value product.
In such cases, the Seller may make a deduction corresponding to the loss in value of the Goods.
This does not exclude the right of withdrawal but may result in a reduced refund amount.
5. Exclusions from the right of withdrawal
The right of withdrawal does not apply in the cases specified in Article 38 of the Consumer Rights Act, in particular in relation to:
a) Goods delivered in sealed packaging which are not suitable for return for health protection or hygiene reasons, if the packaging has been opened after delivery;
b) cosmetics, professional and specialist products, medical devices and other products intended for contact with the skin or body – where their hygienic, sterile or factory seal has been broken;
c) single-use products and products with sterile protection;
d) Goods which are liable to deteriorate or expire rapidly;
e) Goods made to the Consumer’s specifications or clearly personalized;
f) services fully performed with the Consumer’s prior express consent.
Breaking the product seal, including protective foil or sterile packaging, may result in the loss of the right of withdrawal with respect to that Goods, where legal conditions are met.
6. Verification of returns
The Seller has the right to verify returned Goods, in particular by:
a) checking seals and product markings,
b) assessing the condition of the packaging and contents,
c) preparing photographic documentation.
In the event of abuse, including product substitution, tampering with security features or other unlawful actions, the Seller may refuse to accept the return in cases permitted by law or pursue claims against the Customer.
